Kpandai seat is for NPP- SC declares

Published:

The Supreme Court has overturned a High Court decision that annulled the results of the 2024 parliamentary election in the Kpandai Constituency of the Northern Region, effectively ending plans for a by-election and allowing the New Patriotic Party (NPP) Member of Parliament, Matthew Nyindam, to retain his seat.

In a majority decision of four to one, the apex court quashed the November 24, 2025 judgment of the High Court in Tamale, along with all consequential actions and orders arising from it. Justice Gabriel Pwamang dissented.

The Supreme Court’s ruling sets aside the earlier High Court decision that nullified the Kpandai parliamentary results and ordered a fresh election. As a result, the declaration by the Speaker of Parliament that the Kpandai seat was vacant, made following the High Court judgment, has also been rendered ineffective.

Prior to the Supreme Court’s intervention, the Electoral Commission (EC) had announced preparations for a by-election in the constituency, acting on the High Court’s ruling and the Speaker’s declaration.

With the latest decision, the Supreme Court has restored the status quo, confirming Matthew Nyindam as the duly elected Member of Parliament for Kpandai and bringing finality to the legal contest over the seat.

The ruling underscores the Supreme Court’s position as the final arbiter in electoral disputes and brings relief to constituents who had faced the prospect of returning to the polls.
